This Digital Millennium Copyright Act (DMCA) Policy outlines the procedure for reporting claims of copyright infringement and explains how we respond to such notices in accordance with the DMCA, 17 U.S.C. § 512.

1. Reporting Copyright Infringement

3. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:

• Your physical or electronic signature.
• Identification of the material that has been removed or disabled and the location at which the material appeared before removal or disabling.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, mailing address, telephone number, and email address.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days, unless the copyright owner files a court action seeking a court order to prevent the restoration.

4. Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We reserve the right to make this determination at our sole discretion.

5. Limitation of Liability

Cliniquevauban Store acts as an intermediary in good faith and complies with the safe harbor provisions of 17 U.S.C. § 512. Submitting a false or misleading DMCA notice may result in legal liability, including claims for damages, court costs, and attorney’s fees under 17 U.S.C. § 512(f).
